As a Staff Attorney, Labor & Employment , you will, under supervision of the VP of Labor & Employment, represent the Company in all aspects of employment law and traditional labor issues. You will work closely with HR, Operations and Senior Management to respond to employment discrimination charges; ensure compliance with state and federal laws; counsel management on investigations, counseling/terminations, leave issues, and other employment topics; manage outside counsel in employment litigation, and other duties as assigned. With assistance and training, you will negotiate labor contracts, represent the Company in labor arbitrations, defend against unfair labor practice charges before the National Labor Relations Board, train supervisors/managers on union avoidance techniques as well as how to manage effectively in a union environment, and, when necessary, supervise union election campaigns. This the role will serve as one of the Company experts on both employment law and labor relations.
Investigate and respond to EEOC and state law discrimination charges
Train supervisors/managers a variety of legal topics
Ensure compliance with state and federal employment laws, including but not limited to managing reductions in force and applying WARN as needed
Manage outside counsel in litigation in state and federal court
Advise HR and management on day-to-day employment law and labor relations issues including overseeing investigations, addressing leave issues, and advising on how to properly apply state and federal laws and regulations
Serve as a primary labor relations expert, which will eventually include preparing for and negotiating labor agreements, handling grievances and labor arbitrations involving discipline and contract interpretation disputes, defending against unfair labor charges filed against the Company before the NLRB; and managing union organizing campaigns where necessary
Other duties as assigned
Juris Doctorate and Licensed to practice law in the U.S.
Two to Four years of practice experience in the private sector, preferably with a major corporate law firm
Knowledge of primary federal employment laws: Title VII, FMLA, ADA, WARN, ADEA, etc.
Prior exposure to traditional labor law is a plus, but willingness to learn traditional labor is required
Proficient in the MS Office Package
Team player with a positive attitude, who enjoys working in a fast-paced, collegial environment
Clear, concise verbal communicator, active listener
Excellent written communication skills, particular in writing persuasive documents and advisory communications
Ability and desire to quickly learn new areas of the law and the business
Ability to make immediate decisions which have the potential for a large impact on the business where tight deadlines apply
