Position Overview

As Director, Labor & Employment, you will, under supervision of the Vice President of Labor & Employment, work closely with Human Resources, Operations and Senior Management to: handle day-to-day employment relations issues; investigate and respond to EEOC and state discrimination charges; negotiate labor contracts; represent the Company or supervise outside counsel in labor arbitrations, litigation, and unfair labor practice charges before the NLRB; oversee investigations; address wage and hour issues; train supervisors/managers on a variety of legal topics; and, when necessary, supervise union election campaigns. This role will serve as one of the Company experts on labor and employment law, answering questions from the field organization relating to the interpretation of CBAs, state and federal employment laws, etc. on a daily basis. You will have primary responsibility for a variety of employment law and traditional labor matters.

Job Description

  • Advise HR and management on day-to-day employment law and labor relations issues including overseeing investigations, addressing leave issues, interpreting labor contracts, and advising on how to properly apply state and federal laws and regulations

  • Prepare for and negotiate labor agreements

  • Ensure compliance with state and federal employment laws, and supervise outside counsel defending claims in state and federal court

  • Manage grievances and labor arbitrations involving discipline and contract interpretation disputes

  • Investigate and respond to EEOC and state law discrimination charges

  • Train leaders on a variety of legal topics

  • Defend against unfair labor charges filed against the Company before the NLRB

  • Supervise/manage union organizing campaigns where necessary

  • Travel required: Yes

Skills/Experience:

  • Education: Juris Doctor (J.D.) required

  • At lease five (5) years of experience practicing labor & employment law and must be licensed to practice in at least one state. Familiarity with federal employment law (Title VII, FMLA, ADA, WARN, ADEA/OWBA, FLSA, etc.) and multiple states' laws is required.

  • Large firm experience required, with some in-house experience preferred.

  • Traditional labor (union) experience in the private sector is highly preferred.

  • Experience with California law preferred but not required.
