This position is responsible for the day-to-day management of specifically-identified insurance claims matters, as well as the management of other corporate litigation matters as assigned, including the eDiscovery process of all cases. This position engages in litigation avoidance strategies to minimize liability for the company, including responding to subpoena from private parties and government entities and dispute analyses. The position operates under attorney supervision
Manage all phases of litigation efforts including complaint review, preparation of legal responses, reporting and coordination with outside counsel/ carrier/ TPA, coordination of research, identification of witnesses and evidence, collection of documentation, and file maintenance.
Develop, maintain, and implement standards and procedures for E-discovery process and coordinate and manage discovery requests and third-party subpoenae process and responses.
Evaluate and analyze internal due diligence concerning potential and pending lawsuits and insurance claims
Manage and implement company’s litigation hold process.
Coordinate and participate in witness identification, interviews, and preparing for all company testimony, including insurance matters.
Coordinate company’s litigation avoidance and dispute resolution efforts.
Work with internal and third parties related to reported incidents to communicate awareness of the incident and identify reasonable courses of action to reach resolution without the need for litigation.
On specific matters, monitor TPA performance and claim resolution strategies, including fiduciary reserve review and making recommendations for settlement authority.
As necessary, attend mediations, depositions, hearings, and trials to support outside counsel and operations staff, and provide recommendations for settlement authority.
Available 24/7 for reporting process of high-risk insurance claims.
Education/certification :Bachelor’s Degree or equivalent work experience
Experience :5 + years litigation or claims management experience.
Specialized Knowledge: Detailed understanding of litigation, court procedures and claims handling processes; eDiscovery processes; risk analysis; legal hold processes; dispute resolution; understanding and familiarity of following concepts: contract, transportation, PACA, bankruptcy, IP, compliance, and insurance; familiarity with legal research and legal vocabulary; high proficiency with Microsoft Word, Excel, PowerPoint, Adobe, and database management
